Terms of Service

These terms are an agreement between you (and the organization you buy for) and Done Yesterday LLC, doing business as Brainforest ("Brainforest", "we", "us"), of Tempe, Arizona, USA. They apply when you use this website or buy any part of the Brainforest AI Readiness Index. By buying or using it, you agree to them.

1. The products

AI Snapshot, $795. An AI interview and a written report. It includes:

  • Interview, most finish in under 30 minutes
  • Readiness score
  • Opportunity model with sources
  • Where AI would break first
  • 30/60/90-day plan
  • Leadership summary
  • Full report, web and PDF

It does not include live interviews or readout.

Executive Diagnostic, $5,950. It includes:

  • Everything in the Snapshot
  • Live 60 to 90-minute interview with you, plus short interviews with your operations and finance leads
  • Your numbers checked and corrected, and the report reissued
  • Your top 3 moves, ranked, each with a cost range and a first step
  • A vendor-neutral tool shortlist for your #1 move
  • 90-minute leadership readout, recorded
  • 30 days of follow-up questions by email

90-Day Advisory. By application only. Its list price is $18,500. The price and scope in your invoice apply.

2. Payment

  • You pay for the AI Snapshot and the Executive Diagnostic by card, in advance, in US dollars.
  • Stripe processes the payment. Stripe's own terms also apply to it.
  • A paid AI Snapshot can be upgraded to the Executive Diagnostic once, within 90 days of its report. You pay the difference, $5,155.
  • The 90-Day Advisory is paid by invoice.

3. Fee credits

  • Your AI Snapshot fee counts in full toward the Executive Diagnostic or the 90-Day Advisory, if you buy it within 90 days of your report.
  • Your Executive Diagnostic fee counts in full toward the 90-Day Advisory, if you buy it within 90 days of your report.
  • The 90 days start on the day your report is ready. Credits have no cash value.

4. Refund guarantee

This applies to the AI Snapshot and the Executive Diagnostic only. The 90-Day Advisory has no guarantee.

If we can't find at least 10x your fee in sourced, defensible opportunity, we refund the fee in full.

"Sourced, defensible" means every dollar in your report shows its basis: a number you stated, measured against a named benchmark.

To request a refund:

  1. Email hello@brainforest.com from the email address you used to buy.
  2. Use the subject line Refund request.
  3. Include the link to your report.
  4. We confirm within 2 working days.
  5. The refund goes back to the card you paid with, through Stripe. Your bank usually shows it within 5 to 10 working days.

This guarantee is the refund policy for the AI Snapshot and the Executive Diagnostic.

5. The 90-Day Advisory is by application

Apply at our application page. Next comes a 15-minute fit call. If we both decide to go ahead, we send an invoice. We may decline any application.

6. Not professional advice

Reports are for information only. They are not legal, tax, accounting, investment or financial advice. Check with your own advisers before you act. You decide what to do with the report.

7. AI-generated content

  • The interview and parts of the report are generated with AI.
  • AI can make mistakes. Every figure in the report shows its basis. Check each one against your own numbers.
  • Dollar figures are estimates of opportunity. They are not a promise of any result or saving.

8. Your inputs

  • You are responsible for the accuracy of the information you give us. The report is built on your answers. Wrong inputs give wrong results.
  • You confirm you have the right to share that information with us.
  • If a number in your report looks wrong, reply to the email that sent you your report.

9. Confidentiality

  • We keep your answers and your report confidential.
  • They are seen only by the Brainforest team and the lead for your report.
  • We share them with service providers only to run the service. Our Privacy Policy lists them.
  • Your answers are never used to train public AI models.

10. Intellectual property and use of your report

  • Your information stays yours.
  • Your report is for your organization's own use. You may share it inside your organization and with your advisers, board, lenders and investors.
  • You may not resell or publish the report, or use it to build a competing product or service.
  • Brainforest owns its method, software, benchmarks, scoring, templates and website content. You may not copy them, scrape this site or reverse-engineer the interview.

11. Limitation of liability

  • As far as the law allows, we provide the service "as is".
  • We are not liable for indirect or consequential losses, lost profits, or decisions you make based on a report.
  • Our total liability for any claim is limited to the fees you paid us for the product the claim relates to, in the 12 months before the claim.
  • Some places do not allow these limits. There, they apply as far as the law allows.

12. Governing law

Arizona law governs these terms, without regard to its conflict-of-law rules. Any dispute goes to the state or federal courts in Maricopa County, Arizona.

13. Changes

If we change these terms, we update this page and the date at the top. The terms in place when you bought a product apply to that purchase.
